JUDGEMENT
KANWALJIT SINGH AHLUWALIA,J -
(1.) DR .Sadhu Singh Randhawa, Director Public Instructions (Elementary Education), Punjab is present in Court. He has ensured this
Court that in the matters pertaining to his Directorate, due assistance shall
be provided to the counsel for the State so that he could assist the Court in
rendering justice.
(2.) MR .J.S.Puri, Additional Advocate General, Punjab on instructions from Mr.Pawan Kumar, Law Officer, office of Director Public
Instructions (Elementary Education), Punjab has stated that J.B.T. teachers
are entitled to revised pay scale of Rs.1200-2100/- in terms of notification
dated 17.2.1989, Annexure P1 and after rendering 8 years of service, they
are entitled to the scale of Rs.1410-2460/- and senior scale of Rs.1640-
2925/- after rendering 18 years of service. Mr.Puri states that subject to the rider provided in Government instructions issued from time to time, all the
petitioners may have been granted the scales which were due to them in
terms of Annexure P1.
Counsel for the petitioners states that present writ petition was filed on behalf of 46 petitioners. Therefore, each case of the petitioners has
to be examined independently.
(3.) IN case the scales as specified in Annexure P1 have not been granted to the petitioners, they may represent to the Director Public
Instructions (Elementary Education), Punjab who shall consider the each
case individually. Needless to say that any employee, who is entitled to the
higher scale after 8 or 18 years of service, has to comply with the necessary
conditions which have been enumerated by the Government in various
instructions for grant of higher scale from time to time.;
