- (1.) THIS is an appeal under Section 15 of the Consumer Protection Act, 1986 ('the Act') directed against the order passed by the District Consumer Disputes Redressal Forum, Raigarh (hereinafter referred to as the 'District Forum' for brevity) on 15.9.2005 in complaint No. 66/97.
(2.) DISTRICT Forum allowing the complaint has directed the O.P. to pay Rs. 50,000 as compensation for deficiency and interest at 9% per annum from the date of complaint and Rs. 500 as cost of the complaint to the complainant.
(3.) COMPLAINANT Ganga Prasad has averred that he wanted to obtain electric connection for irrigation purposes. It is submitted that the connection was sanctioned in December, 1995 which was not been provided even up to this date. It is also submitted that the connection was deliberately withheld as he did not accede the illegal demand of Rs. 5,000 to the O.P's. officers. A compensation of Rs. 2,50,000 as damages for loss of the crop has been prayed for. It is submitted on behalf of the O.Ps. that the allegations are false and there is no deficiency in service on their part. It is submitted that the O.Ps. intended to provide connections to 500 cultivators in the year 96 -97. Complainant's name appeared at serial number 275 in the seniority list prepared for this purpose. Since, the extension work is not yet complete and other applicants in the said seniority list whose name appears higher in the above list are yet to be provided electric connections. It is also submitted that it is not possible to provide connection out -of -turn. It is also submitted that the complainant has not submitted the Test Report for fittings. It is also stated that complainant did not arrange for PVC wire and obtain a temporary connection.;
