JUDGEMENT

(1.) THIS order will govern disposal of appeal No. 315/10 as well as 316/10, preferred by Assistant Engineer of Chhattisgarh Housing Board, Subdivision Ambikapur, Dist. Surguja and two others against two different respondents, whose complaint cases were decided by District Consumer Disputes Redressal Forum, Surguja -Ambikapur (hereinafter called "District Forum" for short) by similar orders passed on 13.04.10 in two different complaint cases, No. 08/07 and 07/07 respectively, preferred by respondents of these two appeals. The question of law and facts involved in the matter are similar and common, therefore both these appeals have been heard together and are being disposed of by this common order.
(2.) FOR the purpose of convenience, the facts of the case of appeal No. 315/10 are noted in this order. Original of this order be retained in appeal No. 315/10 and its copy be placed in appeal No. 316/10. // 3 //

IT is not in dispute that the appellant Housing Board has promulgated a scheme of construction of Houses for Government employees getting low salary and promised to provide houses of good quality at low cost. The construction area of the house was to be 450 sq. ft. on a plot of 910 sq. ft. Tentative cost of the house was fixed by the appellant as Rs. 2,00,000/ - at the time, when the scheme was formulated, which was subject to change.
The case of the respondent / complainant before District Forum was that he was impressed with the scheme formulated by the appellant Board and booked a house in that scheme by depositing Rs. 30,000/ - as registration charges. Later on he deposited installments as demanded by the appellant. In all Rs. 1,59,000/ - were deposited and only Rs. 41,000/ - were remained to be paid, which was the last installment to be paid at the time of delivery of possession of the house. It is alleged by the complainant that when he requested for delivery of possession, then the appellant Board unnecessarily and without any base raised demand of more amount than the due and had not delivered possession of the House to the complainant, on account of such demand. It was also alleged that quality of construction of the house was also not appropriate and it was of inferior quality. Alleging these facts, consumer complaint was filed before the District Forum. // 4 //;
