- (1.) THIS appeal is directed against the order dated 29.7.2011 of District Consumer Disputes Redressal Forum, Raipur (C.G.) (hereinafter called "District Forum" for short), in Complaint Case No.10/2011, whereby the complaint of the appellant herein, seeking compensation of Rs. 11,956 from the respondent/Insurance Company, has been dismissed on the ground that the Insurance Company has paid the amount as per assessment of the Surveyor and thus, there remains nothing to be paid by the Insurance Company to the complainant.
(2.) UNDISPUTEDLY , an Auto Rickshaw bearing No.C.G.04 -T -1791 was insured by the respondent/Insurance Company and was of the registered ownership of the appellant/complainant. It suffered road accident during the period of subsistence of the insurance policy. It was brought to the authorized service centre, G.K. Motors, Raipur for repairing. The Insurance Company was also intimated. Surveyor was appointed by the Insurance Company. Ultimately complainant was to pay a sum of Rs. 11,956 for repairing the auto rickshaw, but the Surveyor assessed loss of Rs. 1,868 and that amount was paid by the Insurance Company. For the remaining amount, consumer complaint was filed by the complainant before District Forum, which was contested by the respondent/Insurance Company on the ground that amount as per assessment of the Surveyor, has been paid to the complainant and so, no deficiency in service has been committed by it in not paying remaining amount, as per invoice given by the repairer.
(3.) LEARNED District Forurn, agreed with the contentions of the Insurance Company and dismissed the complaint by the impugned order. We have heard arguments advanced by both parties and perused record of the District Forum.;
