JUDGEMENT
Basudeva Panigrahi, J. -
(1.) The petitioner who is at present holding the post of a reader in the department of Radio Physics and Electronics of the University of Calcutta (hereinafter referred to as "the University") has filed this writ petition for issuing a writ of mandamus against the University for quashing the proceeding of the meeting held on December 14, 1988 for selection of an appointment in the post of Professor in the department of Radio Physics and Electronics of the University.
(2.) The petitioner joined the University as a Research Assistant in the year 1968 and worked as such till October, 1973. He, thereafter, joined the post of Lecturer in the department of Radio Physics and Electronics of the University on 1st November, 1973 and served till September 16, 1982. In course of time he was given promotion as a Reader in the same department on and from September 17, 1982. Since then he has been serving as a Reader efficiently, sincerely and satisfactorily. He was also appointed as honorary teacher for M.Phil Course of S. N. Bose Institute of Physical Science, University of Calcutta for the period of 1976 to 1978.
(3.) During the continuance in the teaching post he has claimed to have submitted 75 research papers which were duly published and produced 7 research students who were honoured with Ph.D. (Tech.) degree of the University. An advertisement was published vide EST/ 1/96 by the University authority which has prescribed these following norms for eligibility of a Professor.
"Applications are invited for the following teaching posts of Professors, Readers and Lecturers in scales of pay of Rs. 4,500 - 150 - 5,700 - 200 - 7,300, Rs. 3,700 - 125 - 4,950 - 150 - 5,700 and Rs. 2,200 - 75 - 2,800 - 100 - 4,000 respectively plus admissible allowances.
Essential qualifications and experience:-
(1) Uniformly good academic record with Master's Degree and Bachelor's Degree with Honours of this University or from any other University recognised as such by this University: (ii) Doctoral Degree and/or evidence of continuing research as mentioned by publication in reputed research journals
(a) for Professors - 15 years of which at least 7 years should have been spent in teaching at P. G. level and also have successfully guided research students leading to Ph.D. Degree.
The Syndicate may relax, if so recommended by the Selection Committee on specific grounds, the stipulations regarding qualifications and years of experience in case of candidates possessing exceptionally good academic records and/or outstanding capabilities of teaching/research. The selection committee may also consider suitable persons who may not formally apply.
For posts under the Faculty of Technology and Engineering qualifications as per norms of AICTE, including Post-graduate qualifications in the relevant subject will be required.";
