JUDGEMENT
-
(1.) The petitioner approached the West Bengal Administrative Tribunal (hereafter the 'tribunal') by filing an original application. In such application, she sought for a direction on the respondents to take necessary steps for release of financial benefits that had accrued to her deceased husband, Rabindranath Ghosh, ex-Constable of a police force (hereafter the 'delinquent constable'). The tribunal by its order dated February 7, 2019 disposed of the original application with the following direction:
"..........Under the above circumstances, we direct the applicant to submit an application in prescribed format by furnishing all necessary particulars before the respondent no. 6, Superintendent of Police, North 24-Parganas for release of the amount of GPF of Ashok Ghosh, if the amount of GPF has not been released in the meantime. The respondent no. 6, Superintendent of Police, North 24-Parganas is directed to take necessary steps for release of the amount of GPF in favour of the applicant within a period of 12(twelve) weeks from the date of submission of application in the prescribed form along with all necessary particulars, if the amount of GPF has not been released in the meantime."
(2.) It is this order of the tribunal that the original applicant has challenged before us by presenting this writ petition.
(3.) It is not in dispute that the petitioner's husband while in service as a constable suffered 03 major punishments and 08 minor punishments, apart from being rewarded 06 times. He had also been granted 1117 days EOL on earlier occasions for remaining unauthorisedly absent.;
