JUDGEMENT
Bibek Chaudhuri,J. -
(1.) Affidavit-in-reply filed by the petitioner in court be kept with the record.
(2.) The wife of the petitioner has prayed for transfer of the Matrimonial Suit 134 of 2019 instituted by the opposite party against the petitioner/wife from the court of the learned Additional District Judge, Durgapur to the Court of the learned Additional District Judge at Bolpur on the following grounds:-
a. The petitioner was forced to leave her matrimonial home and started to reside at her paternal home with her parents since 3rd October, 2018 at Viswabharati staff quarters at Santiniketan.
b. It is not possible for the father of the petitioner who is only the male member to accompany her to Durgapur on each and every date during trial of the said Matrimonial suit.
c. The petitioner has no independent source of income and regular travelling to Durgapur will cause financial hardship of the petitioner.
d. If the petitioner is compelled to contest the matrimonial suit at Durgapur, she will have to travel almost 3 hours on one way to reach Durgapur. This will cause physical inconvenience to the petitioner.
(3.) Learned advocate for the petitioner submits that the opposite party/husband has filed affidavit-in-opposition against the application under Section 24 of the Code of Civil Procedure where he clearly stated giving the Bus numbers and the schedule of departure and time taken for the journey from Bolpur to Durgapur and back.
It appears that to reach Durgapur from Bolpur, it takes about 1 hour 30 minutes to 1 hour 45 minutes depending on the nature of Bus. ;
