JUDGEMENT

(1.) By consent of the parties, the appeal is treated as on day's list and taken up for consideration along with the application for stay.
(2.) The instant appeal arises out of a judgment and order dated 10th December, 2018, passed by a learned Single Judge in W. P. 23525 (W) of 2018 (Tamluk Poura Sramik Karmachari Union & Anr. vs. The State of West Bengal & Ors.).
(3.) By the impugned judgment and order, the learned Single Judge was pleased to dismiss the writ petition for such reasons as stated in the said order. For convenience, the impugned judgment and order is reproduced hereinbelow in its entirety:-
"A reasoned order dated September 14, 2017 of the Director of Local Bodies is under challenge in the present writ petition.
Learned advocate for the petitioner submits that, there are grave allegation on the Chairman of the Municipality. Such Chairman was instrumental in preparing a panel. Therefore, interference is called for.
State and the Municipality are represented.
This is the second writ petition in relation to a selection process.
The first writ petition was disposed of by an order dated March 22, 2017 requiring the Director of Local Bodies to give the petitioner a hearing and dispose of the representation in accordance with law. The Director of Local Bodies gave a hearing to the petitioner and disposed of the representation of the petitioner by the impugned order dated September 14, 2017. The impugned order state why, the Director of Local Bodies does not find in favour of the allegations made by the petitioner. Such reasons given in the impugned order cannot be said to be perverse. Moreover, the petitioner received a copy of the reasoned order dated September 14, 2017 in 2017 itself. It affirmed the writ petition in May 18, 2018. It filed the writ petition on November 27, 2018 with the writ petition to appear on December 5, 2018. In view of such conduct also, I am not minded to interfere in the present writ petition.
W.P. 23525 (W) of 2018 is dismissed without any order as to costs.";
