JUDGEMENT

(1.) This is an application under Section 24 of the Code of Civil Procedure filed by the wife/petitioner praying for transfer of Matrimonial Suit No.823 of 2012 instituted by the husband/opposite party from the 2nd Court of the learned District Judge, Serampore, Hooghly to the Court of the learned District Judge, Paschim Medinipur.
(2.) It is stated by the petitioner that her marriage with the opposite party was solemnised on 22nd January, 2006. Subsequent to her marriage, she was subjected to physical and mental torture by her husband. As a result of such marital discord the petitioner started to stay separately from her husband since May, 2012. The petitioner has been working as sub-inspector of police and she is now posted at State Training Centre, Police Department at Salua in the district of Paschim Medinipur as a legal instructor. She has been given the responsibility to act as instructor of law to the trainee officers of Police Department. She is also entrusted to perform other administrative works in the said training centre.

It is contended by the petitioner that the opposite party instituted Matrimonial Suit No.823 of 2012 before the learned District Judge, Hooghly praying for dissolution of marriage against her by a decree of divorce. The learned District Judge transferred the said suit to the 2nd Court of the learned Additional District Judge, Serampore. The said suit is still pending before the learned Additional District Judge at Serampore. According to the petitioner, previously she was posted at Barasat in the district of North 24 Parganas and she could manage to contest the said suit at Serampore. But now she has been entrusted with more responsibility and her higher authority is reluctant to grant her leave to attend the court of the learned Additional District Judge at Serampore to contest the said suit. Therefore, the petitioner has filed the instant application praying for transfer of the said suit to the court of the learned District Judge, Paschim Medinipur.;
