MIR DARA SHEKO,J. - (1.) Heard Mr. Bhattacharya, learned counsel representing the writ petitioner and Dr. Madhusudan Saha Roy, learned counsel representing the respondent nos. 2 to 5.

Dr. Saha Roy at the very outset by handing over the notification no. 90-Edn(U)/1U(WBUTTE)-11/15 dated 30th January, 2017 issued by the Department of Higher Education, Science and Technology and Biotechnology, University Branch, Government of West Bengal, apprised the Court that the B.Ed. course is no more with the University of Gour Banga having its office at Malda, since pursuant to the notification the B.Ed. course conducted by the Government colleges, Government-aided colleges and self-financing private colleges(including colleges run by minorities), which remain affiliated under the University of North Bengal, Vidyasagar University and the University of Gour Banga shall be deemed to have come under the affiliation of the West Bengal University of Teachers' Training Education Planning and Administration and simultaneously those Universities shall be deemed to have ceased so far as making affiliation in respect of those colleges for undergoing with B.Ed. course with effect from 1st February, 2017. Let the said notification be kept on record.

Dr. Saha Roy in his usual fairness submits that the Court may either implead said West Bengal University of Teachers' Training Education Planning and Administration as party in the proceeding or may issue necessary directions so far as the candidate is concerned, since said University is in the seisin to take all care of the candidates of B.Ed. course in taking examination of the semesters.;
