JUDGEMENT

DIPANKAR DATTA,J. - (1.) This intra court writ appeal is directed against the judgment and order dated 29th April, 2016, whereby the writ petition of the appellant was dismissed by a learned Judge of this Court.
(2.) The West Bengal School Service Commission (hereafter the SSC) initiated steps to conduct the 10th Regional Level Selection Test (hereafter the 10th RLST) by issuing an advertisement. We are concerned here with recruitment on the post of assistant teachers in Sanskrit in schools within the Northern Region of the SSC. The advertisement for the 10th RLST notified that there were 8 (eight) vacancies in boys'/coeducation schools whereas there were 3 (three) vacancies in girls' schools. In terms of the prevalent policy, a male candidate can be appointed either in a boys' school or in a co-education school; however, a female candidate can be appointed in all 3 (three) schools viz. boys'/co-education/girls'.

The SSC considered the relative merits of the candidates who were aspirants for appointment in vacancies on the posts of Assistant Teacher in Sanskrit and had prepared separate merit lists of 8 (eight) and 3 (three) candidates for appointment in boys'/co-education schools and girls' schools, respectively. These 8 (eight) candidates included 1 (one) female candidate who, by dint of her performance in the 10th RLST, had secured combined rank of 53. The eighth candidate in the merit list, Suren Modak, had secured combined rank of 57. The appellant was the first wait-listed candidate having secured combined rank of 58. The separate merit list of female candidates prepared by the SSC for girls' schools consisted of 3 (three) candidates, who had secured combined rank of 65, 66 and 67.;
