Abhijit Gangopadhyay, J. - (1.) In this writ application the main prayer of the petitioner is for quashing, cancellation and setting aside of Memo No 89/1 (3) L.S. dated February 13, 2015 issued by the Commissioner of School Education, West Bengal whereby the claim of the petitioner for appointment in a school in the post of a clerk (Wherein his service was ceased) has been rejected.
(2.) The case made out by the petitioner in his writ application is as follows.
(3.) On March 5, 1995 the petitioner was appointed as a clerk of a school namely Adarsha Vidya Bhawan on compassionate ground, due to the death of his father. He joined his duty on November 10, 1995. He started absenting from the school just after 20 days from the date of joining and did not attend school from March 30, 1995 to May 12, 1995. According to the petitioner on May 13, 1995 the petitioner went to join the school after remaining absent but he was not allowed to join.;
