JUDGEMENT

(1.) The Appeal is directed against judgement and order dated 26.08.2013 passed by learned Additional Sessions Judge, Fast Track Court, Rampurhat, Birbhum in Sessions Case No.65 of 2011 arising out of Sessions Trial No.36(6) of 2011 convicting the appellants for commission of offence punishable under Sections 302/34 of the Indian Penal Code and sentencing them to suffer rigorous imprisonment for life and to pay a fine of Rs.10,000/-each, in default to suffer rigorous imprisonment for 2 years each for the offence punishable under Section 302 of the Indian Penal Code, to suffer rigorous imprisonment for life for the offence punishable under Section 304B of the Indian Penal Code and to suffer rigorous imprisonment for three years each and to pay a fine of Rs.3,000/- each, in default to suffer rigorous imprisonment for one year for the offence punishable under Sections 498A/34 of the Indian Penal Code, with a direction that all the sentences shall run concurrently and that the fine amount, if paid, 50% shall be paid to the defacto-complainant as compensation. All the sentences to run concurrently.
(2.) The prosecution case, as alleged against the appellants, is to the effect that the victim, Dolan Dhibar was married to Baidyanath Dhibar, appellant no.1. From the wedlock a female child was born. On 24.1.2010 one Hriday Pramanick informed the father of the victim, Khelaram Dhibar (P.W.1) that his daughter, Dolan had died after receiving burn injuries. Khelaram along with others went to the matrimonial home of his daughter and found her daughter lying naked in burnt condition covered with a chatai (coirmat) in front of the courtyard of the said house which was also burnt down. Her minor child was crying beside her. It was also alleged by Khelaram that one week prior to the date of the incident the husband and father-in-law of his daughter demanded Rs.20,000/- from them and threatened to murder his daughter.
(3.) Over the incident Khelaram lodged written complaint being Mayureswar P.S. Case No.186 of 2010 dated 24.11.2010 under Sections 498A/304B/302 of the Indian Penal Code. In the course of investigation the Investigating Officer seized one green plastic bottle containing kerosene, one plastic bottle with smell of kerosene, burnt straw, burnt bamboo under a seizure list from the place of occurrence. Inquest was held over the dead body of the victim and it was sent for post mortem examination.;
