SHAMPA SARKAR,J. - (1.) Despite service of notice, none appears on behalf of the State respondents when the matter was taken up for hearing on three occasions.
(2.) The petitioner is an Assistant Teacher in Chemistry of Oodlabari High School (HS), Jalpaiguri. The petitioner was recommended by the School Service Commission for appointment as a Teacher in Chemistry in the category of Honours/Post Graduate on August 8, 2010.
(3.) At that point of time, he was a B.Sc. Honours. The appointment letter was issued to the petitioner on August 23, 2010. The approval of appointment to the petitioner was given by the District Inspector of Schools (SE), Jalpaiguri on October 12, 2010. The petitioner had enrolled himself for pursuing his Post Graduate Degree in Chemistry through distance mode from Annamalai University for the sessions 2008-2010. The petitioner had completed all his semester examinations of his Post Graduate Degree prior to his appointment and only the last semester examination was to be completed after joining the service. The petitioner obtained permission from the Managing Committee of the said School. Thereafter the Managing Committee of the said School forwarded the case of the petitioner to the District Inspector of Schools (SE), Jalpaiguri for approval.;
