SHAMPA SARKAR,J. - (1.) This writ application is filed by the petitioner challenging non-action of the respondents in not regulariszing the service of the petitioner as a Group-D Staff of Chowdhurihat Gram Panchayat under Dinhata-II Panchayat Samiti, District Cooch Behar.
(2.) According to the petitioner, the post in Group-D category was vacant in the aforementioned Gram Panchayat and as he had been working since the year 2002 onwards, he is entitled to be regularised.
(3.) On an earlier occasion, this Court had directed the State respondents to file an affidavit. A report in the form an affidavit has been filed and the petitioner was allowed to file an exception to the said report.;
