JUDGEMENT
TAPABRATA CHAKRABORTY,J. -
(1.) Affidavit of service filed by the petitioner be kept on record.
(2.) The learned advocate appearing for the petitioner submits that the petitioner is the owner of a house situated at Medinipur Town. The youngest son of the petitioner, being the respondent no.4 herein is residing in the said house. Whenever the petitioner visits the said house, he is abused and is prevented from entering the house and he is thus not in a position to collect the important documents which are lying in the said house. The private respondents are forcibly occupying the said house and they have also threatened him of dire consequences. Such fact was brought to the notice of the police authorities by a representation dated 26th June, 2018 but no steps have been taken thereafter.
(3.) Mr. Mitra, learned advocate appearing for the State respondents submits that the complaint lodged by the petitioner before the respondent no.2 was forwarded to the respondent no.3 and thereafter an enquiry was conducted and in course of such enquiry the respondent nos.4 and 5 had submitted that they will not resist the petitioner in any manner from entering the said house at Medinipur Town and that they would also shift from the said house in due course of time. However, to maintain peace and tranquility a proceeding under section 107 of the Code of Criminal Procedure, 1973 has already been initiated. Let the written instruction, as produced, be kept on record.;
