JUDGEMENT

(1.) The State of West Bengal is peculiarly ill-served with jumped up bureaucrats pretending to be educated. The case in question is against the present Secretary of the West Bengal Madrasah Service Commission. Despite the orders of the Court, the report which he has filed today through Mr. Dewan shows that he has chosen to read the order dated May 17, 2018 appearing at page 41 of the writ petition as something other than which it clearly means in express terms.
(2.) I need to recount a little bit of background proper appreciation of the case. Madrasah Education through Madrasahs has started from the time of the East India Company. It is a system of education by which a religious minority sought that instructions be imparted to persons professing the Islamic faith, both in religious matters and education, infused with Islamic ethos.
(3.) In Bengal, especially, the right to impart religious instruction has never been fettered or shackled, regardless the religion of the ruler or the ruled or the minority or the majority. After the Constitution of India came into force, Articles 25 to 30 while granting a citizen right to freedom of religion, by way of Articles 29 and 30 also provided for religious and linguistic minorities to establish educational institutions and to impart religious training and education according to their ethos.;
