JUDGEMENT
JYOTIRMAY BHATTACHARYA,C.J. -
(1.) We already indicated in our earlier order dated 18th September, 2018 that for recovery of the loan amounts and for revival of the Bank, a Committee needs to be constituted. Accordingly, we form a Committee which may be called "The Revival and Recovery Committee (in short 'RRC') with the following members:-
(i) Mr. Prasun Ranjan Guupta, Bar-at-Law of Bar Library Club Calcutta, High Court, Calcutta (Mobile No. 9830977253) is appointed Chairman of the Committee.
(ii) Mr. Amarul Helal, Co-operative Development Officer (C.D.O.), Co-operative Directorate and
(iii) Mr. Kashinath Ghosh, Ex-Senior Manager, United Bank of India.
(2.) The primary function of the said Committee would be to recover the outstanding loans of the Bank and take other steps for revival of the Bank. The Committee will be empowered to do all acts incidental to and required for revival of the Bank and recovery of the outstanding loans. The Committee shall be entitled to take assistance from any person that the Committee deems necessary including any of the depositors, any of the Directors and any of the employees of the Bank. The Committee shall also try to find out as to who is responsible for the present condition of the Bank which has led to closure of the business of the Bank. The Committee shall register a complaint against such person with the Superintendent of Police, Howrah District. As and when such compliant is lodged, the same will be investigated by a police officer below the rank of Deputy Superintendent of Police.
(3.) The Committee, for discharging its duty of recovering the outstanding loans from the defaulting borrowers or other persons from whom moneys are due to the Bank and reviving the Bank, shall be empowered to discharge all the functions of the Board of Directors of the Bank and represent the Bank in all respect in that connection. If the Committee finds any case of defalcation of the Bank's fund, appropriate steps shall be taken against the guilty person.;
