JUDGEMENT
Joymalya Bagchi, J. -
(1.) Both the appeals are taken together for the sake of convenience. These appeals are directed against the judgment and order dated 04.06.2015 and 05.06.2015 passed by the learned Additional Sessions Judge, 2nd Court, Krishnanagar, Nadia in Sessions Case No. 02(02)2014 (Special) corresponding to Sessions Trial No. XI(VII)/2014 convicting the appellants for commission of offence punishable under Section 366B of the Indian Penal Code and sentencing them to suffer rigorous imprisonment for ten years and to pay fine of Rs.5000/-, in default, to suffer rigorous imprisonment for six months more.
(2.) The prosecution case as alleged against the appellants is to the effect that appellants were trafficking three minor Bangladeshi girls for illicit sexual exploitation. On 03.02.2014 they had taken the girls to Bagula Railway Station for onward movement to Sealdah. The girls started weeping and on the advice of a woman in the railway station they board a train coming from Sealdah towards Gede. On reaching Gede they were loitering in the railway station. Some officers attached to the immigration department questioned them. Thereupon, they disclosed their identities and said that they had been kidnapped and were taken to Sealdah. They also stated that they could identify the person who had kidnapped them. Soon thereafter Mizanur arrived at the said railway station and was identified by the girls. He was apprehended. Upon questioning him identities of the other accused persons, namely, Santi Mondal @ Shaalam @ Shahalam Mondal and Mizanur Malita @ Toton were disclosed. Soon thereafter they also came to the railway station and were apprehended.
(3.) Written complaint was lodged by S.K. Das, attached to Immigration Department, Gede with Krishnagang P.S. resulting in registration of Krishnagang P.S. Case No. 37/2014 dated 03.02.2014 under Sections 366B/370/372/373B/34 of the Indian Penal Code and Section 14 of the Foreigner's Act and Section 5 of the Immoral Traffic Prevention Act and Section 12 of the POCSO Act.;
