JUDGEMENT
Debangsu Basak, J. -
(1.) Four writ petitions are taken up for analogous hearing as they involve the same issues. WP No.661(W) of 2017 is treated as the leading matter. This judgment will govern the other three matters.
(2.) Learned advocate for the petitioner submits as follows. The State of West Bengal by a Gazette notification (Kolkata Gazette) dated January 30, 2014 declared vacancy of dealership at Jalpaiguri district. The petitioner participated in such selection process and became successful thereat. The petitioner altered material position, to its prejudice, on the basis of directions issued by the State in terms of such notification. The petitioner kept deposit a sum of Rs.5,00,000/- in its bank account. It constructed a godown in terms of the parameters laid down by the State by making expenditure. It maintained the requisite bank balance. Now, by the impugned notification August 17, 2015 the State is seeking to cancel such selection process. The justification for cancellation given in the impugned notification dated August 17, 2015 is the coming into effect of the National Food Security Act, 2013. Such Act of 2013 was in force prior to the notification dated January 30, 2014. Therefore, the authorities are deemed to have taken into consideration the parameters laid down in the Act of 2013 while declaring the vacancy on January 30, 2014. According to him, the authorities cannot resile from their declared position. Moreover, the petitioner has altered its material portion to its prejudice. Therefore, the impugned notification dated August 17, 2015 should be quashed.
(3.) The State is represented. Learned advocate for the State submits that the selection shown pursuant to the notice dated January 30, 2014 does not vest the petitioner with any justiciable right to agitate before a Writ Court. Moreover, the notification dated August 17, 2015 is in accordance with the Act of 2013.;
