JUDGEMENT

(1.) The subject matter of this writ petition, filed as a public interest litigation, is a pond measuring about 0.82 decimals of land and a cremation ground which is said to be measuring about 6.42 acres of land. The petitioners are inhabitants of three villages viz., Lalbandh, Palashdanga and Naldanga in the district of Bankura. The allegation of the petitioners is that the pond is being filled up by illegal construction and deposit of silt, bricks etc. Their further allegation is that the private respondent Nos. 6, 7 and 8 have encroached on the cremation ground and have turned part of the same into agricultural land.
(2.) We have heard learned counsel for the parties. Mr. De, learned counsel representing the State-respondents hands up a notice dated 25th July, 2017 issued by the Block Land & Land Reforms Officer, Patrasayer, Bankura addressed to, amongst others, the private respondents directing them to stop filling up the said pond and restore the said pond to its original state. Hence, the grievance of the petitioners, insofar as the pond is concerned, stands redressed.
(3.) The Block Land & Land Reforms Officer, Patrasayer, Bankura shall ensure that the pond is restored to its original state and character. If the Block Land & Land Reforms Officer, Patrasayer, Bankura has to spend any money for restoration of the said pond to its original character, he shall recover the same from the persons responsible for filling up the said pond.;
