JUDGEMENT

(1.) The instant writ petition is filed challenging an order dated 15 December, 2014 inter alia, rejecting the petitioner's application for compassionate appointment.
(2.) The brief facts culminating in filing of the instant writ petition are that the petitioner applied for a license on 15 March, 2010 to enable him to continue operations of the fair price shop after the demise of his uncle on 14 March, 2010. It is an admitted position that the petitioner is one of the legal heirs of the Late Shib Das Dey. Pursuant to an earlier writ petition, by an order dated 10 July, 2014, the Hon'ble Justice Joymalya Bagchi directed the concerned respondent to consider the petitioner's representation for compassionate appointment in accordance with law.
(3.) By the impugned order dated 15 December, 2014 the concerned respondent rejected the petitioner's application for compassionate appointment inter alia on the ground that as per the provisions of the West Bengal PDS (M & C) Order 2013 and particularly under para 20 (vi) thereof the petitioner did not fall within the definition of a "family member" and therefore was not entitled to obtain the MR.
