JUDGEMENT

Dipankar Datta, J. - (1.) The report of the District Engineer, South-West District of the CESC Limited (hereafter the district engineer) dated 2nd February, 2018, prepared upon an inspection conducted in furtherance of the order dated 19th January, 2018 passed by this Bench, has been placed for consideration by Mr. Das, learned advocate for the CESC Limited. Paragraphs 5 and 6 of the said report are relevant for the purpose of disposal of the writ petition and, accordingly are set out below: "5. That in course of inspection the petitioners identified a place near the stair case which is under their possession. Both the petitioners present proposed to install two meters in their names thereat which will cater the load to the first floor of the said premises only. 6. That during such inspection both the petitioners were requested to identify alternative place for common meter board position which will be technically suitable to provide supply. The petitioners insisted to provide supply to the aforesaid place near the stair case which is not at all common place of the petitioners and said Sri Kali Charan Banerjee. Moreover, it is not technically suitable to build up a meter room thereat."
(2.) It is thus clear that the place near the stair case identified by the petitioners has been rejected on two fold grounds: first, it is not the common place of the petitioners and the private respondent; and secondly, it is not technically suitable to build a meter room there.
(3.) It also appears from the report that the private respondent owes in excess of Rs. 8,000/- to the CESC Limited and supply of electricity to the part of the premises occupied by him is liable to be disconnected. Even then, the CESC Limited has not disconnected his supply.;
