Decided on August 09,2018

Ranjit Kumar Paul And Ors. Appellant
VERSUS
Hindustan Petroleum Corporation Limited And Ors. Respondents

JUDGEMENT

TAPABRATA CHAKRABORTY,J. - (1.) The present writ petition has been preferred challenging, inter alia, a letter dated 9th July, 2018 issued by the respondent no.3.
(2.) Mr. Bhattacharya, learned Senior Advocate appearing for the petitioners submits that the petitioners are the partners of the firm, namely, Central Service Station (in short, the said firm). The said firm was appointed as a dealer of Hindustan Petroleum Corporation Limited (in short HPCL) on the basis of a dealership agreement executed on 14th July, 1993 pertaining to premises nos.17/2 and 27, Jatindra Mohan Avenue, Kolkata - 700 006. Thereafter a fresh dealership agreement was executed on 23rd March, 2010. As the said agreement was due to expire on 13th July, 2018, an application for renewal was submitted by the petitioners on behalf of the said firm. Surprisingly, by a letter dated 9th July, 2018 the petitioners were requested to attend the office of the respondent no.3 for signing a dealership agreement for renewal pertaining only to premises no.27, Jatindra Mohan Avenue.
(3.) He further submits that no reason was communicated to the petitioners as to why the agreement pertaining to premises no.17/2, Jatindra Mohan Avenue cannot be renewed. Such action of the respondents is arbitrary and unreasonable and that necessary direction needs to be issued upon the respondents to renew the agreement pertaining to both the premises.;
