JUDGEMENT

DEBASISH KAR GUPTA,J. - (1.) Let the affidavit-of-service filed today in Court be kept on record.
(2.) This writ application is directed against a final order dated July 31, 2018 passed by the West Bengal Administrative Tribunal in the original application. By virtue of the order impugned to this writ application, the original application was dismissed.
(3.) It is the bone of contention of Mr. L. K. Gupta, the learned Senior Advocate appearing on behalf of the petitioners that the petitioners were initially appointed in the posts of Homoeopathic Medical Officers under the West Bengal Homoeopathic Health Service. Subsequently, by an order dated December 9, 2013, all of them were appointed in the posts of Lecturers in the four State Homoeopathic Medical College. Initially, such appointments were made for one year or till filling up of those posts of Lecturers on regular basis, whichever was earlier. The period of those appointments were thereafter extended from time to time. According to Mr. Gupta, the aforesaid appointments were made by invoking the provision of Section 21 of the West Bengal State Homoeopathic Health Service Act, 2002 read with its amendments. Therefore, according to Mr. Gupta, a subsequent attempt to fill up the aforesaid vacancies by way of initiating the recruitment process, was not permissible under the law.;
