JUDGEMENT

(1.) On July 10, 2018, I have passed an order under compelling circumstances, created by the Headmaster of the concerned school. Relevant part of the order is provided below:
"It is clear from the attitude of the Headmaster that he does not wish to comply with the order of this court and is using dilatory tactics for reasons best known to him. It is unfortunate that the sanctity of this court is being abused by the Headmaster only to satisfy his ego. Reluctantly, this court is forced to take stringent action against this Headmaster that are delineated sheets below:-
(a) The District Inspector of Schools is directed to carry out an enquiry with regard to the activities of the Headmaster.
(b) The District Inspector of Schools is directed to stop making payment of salary and other emoluments to the Headmaster being the respondent no.9 till he completes the work as ordered by this court on earlier occasions to the satisfaction of the District Inspector of Schools.
(c) The District Inspector of Schools is directed to file a report within two weeks on the actions taken as per the order passed today.
Matter shall appear on July 24, 2018. All parties are to act on the server copy."
(2.) The District Inspector of Schools (S.E.), Bankura has filed an enquiry report as per my earlier order. The report clearly reveals that on the date of enquiry, that is, July 17, 2018, the Headmaster was absent in school. The enquiry report further reveals that the Headmaster was very irregular in the school and the administration of the school was suffering greatly because of his lackadaisical attitude. The report further reveals that the strength of the school has come down drastically from 283 in the year 2014 to 174 in the year 2018. The report further reveals that the SC/ST hostels in the school had been shut down since 2014 resulting in the students being deprived of the hostel facilities. This could also be a reason for reduction of the number of students. The report further reveals that in terms of the Memo of the West Bengal Board of Secondary Education bearing no.Ban- 371/18/G/3 dated 13.04.2018 the Sub Inspector of Schools, Raipur Circle, Bankura has been appointed as the Administrator of the said school but the Headmaster has refused to give charge to the Administrator. The term referred to in the Report with reference to the attitude of the Headmaster of the said school in discharging his duties in the school is "Tughloki" attitude.
(3.) The report further shows that the salary of the teaching and non-teaching staff that is made through on-line i-osms portal may be made as the login ID and password is with the Headmaster and he has forwarded the relevant salary bills to the District Inspector of Schools(S.E.), Bankura. The report further reveals that the Assistant Inspector of Schools (SE), Khatra Subdivision, Bankura in his memo no. 24/KSD dated 20.07.2018 reported that seven teaching and nonteaching staff of the said school who either retired or were transferred two to five years ago did get their provident fund money due to non-submission of relevant papers by the Headmaster of the said school who is the sanctioning authority of provident fund final payment. Needless to say, the documents in relation to the present writ petitioner Sri Satya Ranjan Dey, retired Group 'D' staff have also been forwarded to the District Inspector of Schools (SE), Bankura for action to be taken for disbursement of the pension.;
