JUDGEMENT
MIR DARA SHEKO,J. -
(1.) After hearing Mr. Bhattacharyya, learned senior Counsel representing the writ petitioners being assisted by Mr. K. S. Alam and Mr. Raju Bhattacharyya and also Mr. Manna, learned senior Counsel, representing the State being assisted by Mr. Sanjib Das, the matter is taken up for recording disposal order on merit.

Mr. Bhattacharyya submitted that the writ petitioners pursuant to the call letter issued on 21st April, l984 had faced interview on 26th April, l984 to work as Health Workers under the Scheme Aganwari under Budge Budge Municipality and after being selected list was finally published the same on 26th April, l988, and the name of the petitioners appeared as honorary health workers in respect of Budge Budge Municipality under CUDP-III Health Programme respectively under serial nos. 11,13,15,10,16,8,14,3,9,12,4 and respondent no. 11 was under serial no. 7 of said list.

It is submitted that after publication of said list of honorary health workers, amongst them the petitioner no. 1 has been getting honorarium at the rate of Rs. 5,000/- and the rest at the rate of Rs. 4,800/-. Mr. Bhattacharyya, of course, in his usual fairness submits that all the writ petitioners had no enforceable right, but they deserve some consideration due to long continuation of service and since they have been working till today and since the scheme still is in existence and since the Municipal authority has been taking their services, and therefore, the authority cannot deny if any scope remains for their absorption. In support of such submission, Mr. Bhattacharyya relies upon the circular dated 31st December, l991 which was, of course, published after a few years of engagement of the writ petitioners as the Health Workers.;
