JUDGEMENT

(1.) Party/parties are represented in the order of their name/names as printed above in the cause-title.
(2.) In this writ petition challenge is thrown to the denial of permission to the petitioner for participating in the selection process for appointment to the post of Assistant Professor (AP) for General Degree Colleges under the West Bengal College Service Commission (for short WBCSC). It is relevant to note that the essential factual matrix connected to the issue arise from the advertisement issued by the WBCSC in the year 2012 for the recruitment of Assistant Professor (APs) in General Degree Colleges. The UGC Regulations, 2009, as amended by its Regulations of 2010 (respectively the 2009 and 2010 Regulations) had mandated that the minimum eligibility condition for recruitment as AP in a General Degree College was for the candidate to have successfully cleared the NET/SLET Examination. However, in the case of candidates conferred with Ph.D Degrees in compliance with the 2009 Regulations (supra), the minimum eligibility condition of NET/SLET (supra) stood waived.
(3.) Mr. Roy, learned Counsel for the petitioner emphasises that the petitioner has the requisite qualification for applying for the post of AP and, prior to the publication of the 2009 Regulations, the petitioner had acquired Ph.D Degree under the Visva Bharati University.;
