JUDGEMENT
Jayanta Kumar Biswas, J. -
(1.) I do not find any reason to accept the allegation of inaction on the part of the municipality. The complaint was made on March 3rd, 2008, it is not known at what time of the day. The writ petition was taken out on March 5th, 2008, and the petitioner wanted this court to hear it on March 7th, 2008. It could be moved ex parte, if there was grave urgency, but it was not.
(2.) It is apparent that the municipality was not given a reasonable time to look into the complaint. It is alleged that the private respondent has been making constructions without obtaining sanction. It is not that the constructions cannot be demolished, if it is found that they have been raised unauthorisedly. I am unable to appreciate the manner in which the petitioner rushed to the writ court alleging inaction on the part of the municipality.
(3.) For these reasons, I dismiss the writ petition making it clear that if after a reasonable period the petitioner finds that the municipality failed and neglected to take steps on the basis of his complaint, then he will be at liberty to approach the appropriate forum by initiating appropriate proceedings in accordance with law.
There shall be no order for costs.;
