JUDGEMENT

(1.) The petitioner, by filing the instant application under Article
226 of the Constitution, has sought to assail order No. 9 dated 21st September, 2007 passed
by the District Magistrate, Cooch Behar. The said order was passed in compliance with the
order dated 13th July, 2007 passed by learned Single Bench of this Court in W.P. No.
26711(W) of 2006.
(2.) The backdrop of the present case may briefly be stated as follows:-
A notice was issued in leading English and Bengali dailies on 9th June, 2006 for
recruitment in the post of Block Accounts Manager on contractual basis at various Blocks
of West Bengal. It was clearly mentioned in the said advertisement that 'preference will be
given to candidates having residence in the Block for which application has been made.
(3.) Selection on the basis of marks obtained in Madhyamik, Higher Secondary and Bachelor
Degree examination and viva voce.' The State Mission Director, National Rural Health
Mission and Ex-officio Special Secretary by letter dated 27th July, 2006 made certain
clarification with regard to selection criteria. It was clarified that the short list of candidates
has to be done block-wise on the basis of merit. A panel of sufficient number of candidates
(at least 1.5 times the number of Blocks) at the District level has to be prepared. In case of
blocks where no suitable candidate is available for engagement as Block Accounts
Manager, the offer may be given to suitable candidates of the adjoining Blocks.;
