JUDGEMENT

(1.) This petition is being disposed of only on the question of territorial jurisdiction and on no other question. All other questions would be left open to be decided by the appropriate Court.
(2.) The respondents have objected to the jurisdiction of this Court on the ground that no cause of action or any part of it has arisen within the territorial jurisdiction of Calcutta High Court. In order to appreciate the question relating to the jurisdiction of the Calcutta High Court, it shall be worthwhile to look into the prayer of the writ petitioners. The petitioners claimed the following reliefs :
1) A direction upon the respondents to allow the petitioners to appear in the examination for selection to the post of Engineers (Excavation) Grade II;
2) To hold written examination as special case for the petitioners;
3) Thereafter to hold the oral examination along with others.
(3.) The petitioners claim to be the employees of Bharat Coking Coal Limited whose General Manager has been impleaded as respondent No. 2 in the petition. The respondent No. 1 is the Union of India and its service is being sought through the Director, Coal India Limited, 10, Netaji Subhas Road, Calcutta. The petitioners undoubtedly are the employees of Bharat Coking Coal Limited. It is claimed by the petitioners that Bharat Coking Coal Limited is a subsidiary of Coal India Limited and since the Head Office of Coal India Limited is at Calcutta, this petition has been filed in this Court.;
