JUDGEMENT
Barin Ghosh, J. -
(1.) There will be an order in terms of prayer (B) of the petition.
(2.) By consent of the parties, an appeal is treated as on the order list.
(3.) The plaintiff being the respondent No 1 before us filed a suit where amongst others a relief by way of permanent injunction had been sought for against the defendant No 1 in the suit who is appellant before us from realising any amount under two letters of credit and also against the defendant Nos 2 and 3 in the suit, viz., Bank of India and State Bank of India, from making any payment under the aforesaid two letters of credit issued by them respectively. In the suit, the plaintiff made an interlocutory application praying for temporary injunction in aid of its prayer for permanent injunction. On that interlocutory application on 17.2.97 an order was passed restraining the defendant Nos 2 and 3, i.e., the banks named above from paying any amount under the letters of credit being the subject matter of the application. The learned Judge while passing the said order dated 17.2.97 specifically granted leave to the defendants to apply for variation or vacation of the order upon notice to the plaintiff and the application was made returnable on 26.2.97.;
