JUDGEMENT
ARIJIT BANERJEE,J. -
(1.) In short, the petitioner prays for a direction on the respondent no.16 which is the Andhra Association High School to admit the petitioner's children and impart free education to them. The two sons of the petitioner for whom he seeks free admission are Gourav Dwivedi and Aditya Dwivedi. The petitioner contends that he and his family members have been subjected to physical attacks by the respondent nos. 17 and 18 and their anti-social associates, as a reason whereof, the petitioner and his family members are suffering from various diseases and are living an extremely distressed life since August 2013.
(2.) The petitioner claims to be undergoing medical treatment at the institute of psychiatry, Government of West Bengal since November 2014 for deep depression. He contends that he has lost his job and is in acute financial crisis and, as such, he is unable to provide proper food and medical treatment to his family and is also unable to pay the school fees of his children.
(3.) It appears that the petitioner's elder son Gourav was a student of class IV in the respondent no.16's school. The petitioner has made a request to the headmistress of the said school for considering Gourav's school-fees but no response has been received by him to such request. The petitioner contends that both his sons Gourav and Aditya have a right to free and elementary education under The Right of Children To Free And Compulsory Education Act, 2009 (in short RTE Act). His prayer is that the respondent\school should allow Gourav to continue his studies at least still class VIII free of costs and also admit Aditya in class II without demanding any fees.;
