JUDGEMENT

- (1.) This may still not be the end of the drama between two candidates to secure the position of a clerk in a government-aided school. The principal dramatics personae are the appellant and the eighth respondent herein. The eighth respondent is firmly ensconced in the post, having obtained his appointment sometime in 2012.
(2.) It is not necessary to recount the entire history of the tussle between the appellant and the eighth respondent to secure the post. The starting point for the present purpose may be taken to be an order of December 23, 2011 passed in an appeal filed by the eighth respondent against an order of April 8, 2010 passed on the present appellant's earlier petition. The appellate order in MAT 622 of 2010 arising out of WP 13825(W) of 2009 provided for a fresh exercise to be undertaken on the following lines: "... Under this circumstances, we think that fresh typing test has to be undertaken and this test shall confine to the three top-most candidates. This shall be done by the School Authority and for this purpose the D.I. will depute an Officer of his choice subordinate to him for observing typing test to be undertaken by the Selection Committee ... ."
(3.) The order also provided for the typing test to be conducted within seven days after the constitution of the committee and for the results to be submitted to the relevant District Inspector of Schools within a fortnight thereafter for the DI to take a decision on the matter within 30 days of the receipt thereof.;
