JUDGEMENT

(1.) In re: CAN 9455 of 2017 in MAT 1622 of 2017
This is an application under section 5 of the Limitation Act. Having heard the learned advocates for the parties and upon perusing the application for condonation of delay, it appears that sufficient cause has been shown by the appellant/applicant to explain the delay in filing of the appeal. As such, the delay is condoned. The application for condonation of delay, being CAN 9455 of 2017, is accordingly allowed.
In Re: MAT 1486 of 2017 and MAT 1622 of 2017
(2.) By consent of the parties, both the appeals are treated as on day's list and taken up for consideration along with the connected applications. Both appeals have been preferred against the following order dated 1st August, 2017, passed by a learned Single Judge in WP 19662 (W) of 2017 (Srikanta Sinhababu vs. The State of West Bengal & Ors.):-
"Affidavit of service filed by the learned Advocate for the petitioner in Court today be kept on record.
After going through the impugned order dated 15th June, 2017 passed by the District Magistrate, Bankura, I find that there is no ambiguity and/or illegality in the impugned order which deserves no interference by this Hon'ble Court.
Accordingly, this writ petition fails.
However, there will be no order as to costs."
(3.) The appellant before us in MAT 1486 of 2017 was the writ petitioner, whereas the appellant in MAT 1622 of 2017 was the private respondent no.5 before the writ Court in respect of WP 19662 (W) of 2017.;
