JUDGEMENT
Mir Dara Sheko, J. -
(1.) Let the affidavit of service be taken on record.
(2.) Heard Ms Pal being assisted by Mr Dhara and Mr Naskar representing the writ petitioner and heard also Mr Sengupta assisted by Mr Pal representing the State.
(3.) Ms Pal ventilated the grievance that the father of the writ petitioner was a licence holder as big dealer in distributing kerosene oil. He died on June 30, 2017. As the said dealership being the only source of earnings the writ petitioner taking no objection from his sister and his mother submitted an application before the Sub-divisional Controller, Food & Supply, Medinipur on July 17, 2017. Since no consideration yielded till date the writ petitioner again submitted a representation on August 17, 2017 and ultimately the respondent by passing an order dated September 22, 2017 as was communicated on October 11, 2017 rejected the prayer of the writ petitioner and in granting SK oil dealership (erstwhile BD) indicating however that the writ petitioner may get SK oil retailership as per paragraph 6 of the West Bengal SK Oil Control Order, 1968 and as amended in 2014 provided the petitioner fulfils all criteria. During hearing learned counsel for the petitioner cited two instances: one in the case of Sarathi Das which was considered in terms of the order of this court passed in WP No.12049(W) of 2016, and the other is a circular issued on June 2, 2017 by the Principal Secretary, Food & Supplies Department, Government of West Bengal.;
