Biswanath Somadder, J. - (1.) By consent of the parties the appeal is treated as on day's list and taken up for consideration along with the application for stay.
(2.) The instant appeal arises out of a judgement and order dated 17th October, 2017, passed by the learned Single Judge in W.P. 25731 (W) of 2017 (Md. Muktar Ali Gazi & Ors. Vs. The State of West Bengal & Ors.).
(3.) The appellants before us were the private respondent nos.9 and 10 in the writ proceeding.;
