JUDGEMENT

(1.) This is a completely misconceived petition by the petitioners who may not have any right, title or interest in respect of an immovable property though a suit is being pursued in respect thereof.
(2.) The case made out by the petitioners is thus: The petitioners were the owners of a property that was sold under six different deeds to the opposite party no.8 herein. The petitioners claim that though the transfer of such property was registered, the cheques issued by way of consideration were dishonoured upon presentation and substituted cheques met the same fate. The petitioners filed a suit for cancellation of the sale on the ground that no consideration had passed. It may bear repetition that the registration of the transfer in favour of the opposite party no.8 had been effected.

The petitioners claim that the opposite party no.8 had obtained credit facilities from UCO Bank and defaulted in repayment thereof, whereupon UCO Bank took steps against the assets of the opposite party no.8, including the land sold by the petitioners herein to the opposite party no.8. According to the petitioners, UCO Bank surreptitiously sold the land to the opposite party no.1 herein notwithstanding the pendency of the suit and the interim orders that the petitioners herein may have obtained therein.;
