JUDGEMENT
Sambuddha Chakrabarti, J. -
(1.) This writ petition is directed against the inaction on the part of the police authorities as well as the Kolkata Municipal Corporation (the Corporation, for short) in taking steps against the respondent no. 1 for the alleged illegal construction carried on by them.
(2.) The case of the petitioner inter alia is that he is the owner of the premises at 12, Manohar Das Street, Kolkata- 700 007. On November 8, 2016, the petitioner by a letter informed the Officer-in-charge of the concerned police station i.e., of the respondent no. 7, that the tenant of the adjacent building being 13, Manohar Das Street, had illegally constructed an entire floor using the wall of the premises of the petitioner. By a letter, dated December 2, 2016, the petitioner further informed the Executive Engineer of the Kolkata Municipal Corporation, i.e., the respondent no. 3, about the illegal construction which was going on at the said premises and requested him to take a necessary steps for stopping such illegal construction so that no damage was caused to the premises of the petitioner. The petitioner also sent second complaint to the respondent no. 7 intimating him of the construction being carried on by the tenant. This time the petitioner further informed him that when he had requested the tenant not to continue with the unauthorized construction he was abused in filthy language. The petitioner also made contemporaneous complaints on various days.

Since the petitioner did not received any communication from the respondents he had taken out an application under the Right to Information Act before the appropriate authority of the Corporation. The petitioner alleges that the said illegal construction having been made on the wall of his premises by using the water tank from his tank is endangering the lives of the residents of the petitioner's family. He has, therefore, inter alia prayed for directions upon the respondents to stop the unauthorized construction and then to demolish the same at 13, Manohar Das Street.;
