JUDGEMENT
MIR DARA SHEKO,J. -
(1.) The petitioner has filed this revisional application under Article 227 of the Constitution of India being aggrieved by an order dated April 8, 2016 passed by learned State Consumer Disputes Redressal Commission, West Bengal in FA No.874 of 2014 preferred by the bank modifying the order dated June 19, 2014 passed by the District Consumer Disputes Redressal Forum, Kolkata, Unit-II in a complaint case (CC No.106 of 2014) filed by the petitioner.
(2.) Mr Mandal appearing in person submitted that both the forums - District and State Commission - did not appreciate and consider his prayer for compensation properly. He contended that the bank (IndusInd Bank) had practised fraud against him. Submitted that though a cheque for encashing of Rs. 15,001/- (Rupees fifteen thousand and one only) was handed over to the bank, but with a collusive motive the concerned bank had debited to his account only Rs. 1,500/- (Rupees one thousand five hundred) only. Submitted further that after passing the impugned order by the State forum modifying the order of the District forum under reference, the bank had sent a letter dated April 19, 2016 accompanying a cheque of Rs. 20,000 - Rs. 15,000 as compensation and Rs. 5,000 as litigation costs - to him. But being dissatisfied with the amount he returned the said cheque to the bank by sending a letter dated July 29, 2016 along with a legal notice informing about pendency of the proceeding before this court. Six sheets of paper on which Mr Mandal also relied during course of hearing to show the return of the cheque worth of Rs. 20,000 and other documents be taken on record for future reference.
(3.) Heard Mr Mandal, the petitioner appearing in person, and Mr Bag assisted by Mr Ghosh and Mr Pramanick representing the bank and perused the materials available on record.;
