JUDGEMENT
Kalyan Jyoti Sengupta, Arun Kumar Bhattacharya, JJ. -
(1.) Two appeals have been preferred against the same judgment and order of the learned Trial Judge. Mr. Mukherjee's client, being the respondent No. 5 in the writ petition, has been successful to get a quantity of 4.000 (four thousand) M.T. of feed category rice which was declared to be unfit for human consumption.
(2.) The grievance of Mr. Das's client being the writ petitioner, is that his client was prevented from participating in the tender process and his client's offer was not accepted. It is the further grievance of the writ petitioner that Mr. Mukherjee s client was not the genuine and eligible buyer of this kind of commodities.
(3.) The learned Trial Judge found that Mr. Das's client was prevented from participating in the tender, as a result whereof, the learned Trial Judge granted relief directing the Food Corporation of India to supply 2.000 (two thousand) M.T. of feed category rice upon fulfilling all terms and conditions to Mr. Das's client. The learned Trial Judge at the same time found that there was some Illegality for which C.B.I. enquiry is required. The learned Trial Judge directed C.B.I. enquiry based on the statements and averments made in the pleadings by one of the parties.;
