JUDGEMENT

Satyabrata Sinha, J. - (1.)F.M.A.T. No. 3100 of 1996 is directed against an order dated 11.9.96 passed by a learned single Judge of this court in C.R. No. 9635(W) of 1984 whereby and whereunder the said learned Court refused to review the order dated 31st July, 1996.
(2.)F.M.A.T. No. 3114 of 1996 is directed against an order passed by the same learned Judge dated 22.11.1985 in C.R. No. 9635(W) of 1984 whereby and whereunder the aforementioned order dated 11.9.96 was corrected.
(3.)An application under Sec. 5 of the Limitation Act has been filed in the later appeal as the said Appeal is barred by 300 days. The appellants in both the appeals are said to be the Secretary, Managing Committee and the Headmaster of Vivekananda Pally Kishore Bharati High School (hereinafter referred to as the said school). The said school is a X-Class High School and affiliated to the West Bengal Board of Secondary Education. The respondent No. 1 is said to have been appointed on 20.3.1975 as an assistant teacher of the said school. Allegedly he was absent for 42 days in a year and his services were terminated purported to be in terms of letter of appointment dated 27.3.76.
