Shyamal Kumar Sen, J. - (1.) The facts inter alia involved in this writ petition are that the petitioner retired from the Indian Police Service as Director General of Police in West Bengal on 31st January, 1992 but has not received any retirement benefit.
(2.) On and from 1st February. 1978 the petitioner who was an IPS Officer of 1957 batch, was occupying flat No. H/A/6, Jadavpur Police Housing Estate, 1, Raja S. C. Mallick Road, Calcutta-32 which was allotted to him by West Bengal Police Directorate on rent @ 11% of his pay.
(3.) In 1987, rent of that flat was fixed at Rs. 275/0 per month which was recovered from his monthly Pay Bills till December, 1991. The said flat was never rent free as alleged by the respondents.;
