JUDGEMENT
M.N. Roy, J. -
(1.) This is an application by respondent nos. 6, 7 and 8 in the appeal for extension of time for presentation of a Deed of Conveyance on affixation of necessary non judicial stamps to the learned Registrar, Appellate Side, High Court, Calcutta.
(2.) One Promod Kumar Ghosh (since deceased) the predecessor-in interest of defendant/respondents no 1-4 filed a suit and prayed for a decree of preemption against one late Tarun Kumar Ghosh & Ors and the appellant Calcutta Electric Supply Corporation Ltd , in respect of the sale of the property at Harish Mukherjee Road to the said Calcutta Electric Supply Corporation Limited. On the death of the said Tarun Kumar Ghosh, the respondent nos. 6, 7 and 8 in the appeal who are petitioners before us were added us defendants. The learned Subordinate Judge, Alipore was pleased to issue the declaration and decree in favour of the plaintiff's Against such determinations the Calcutta Electric Supply Corporation Limited filed an appeal and they having failed to obtain an order of stay from this Court, preferred an appeal to the Hon'ble Supreme Court of India, which was pleased to pass an order staying the operation of the judgment and decree as passed by the learned Subordinate Judge. Alipore While issuing the order of stay as mentioned above, the Hon'ble Supreme Court of India had also directed this Court to hear out and dispose of the appeal.
(3.) Thereafter, the parties lo the proceedings and in the appeal before this Court elected to have their disputes amicably settled and accordingly a petition of compromise dated 17th July 1985, signed by all the parties was filed and the said petition of compromise was disposed of by us on 19th July 1985 and in terms of the said order the concerned first appeal was disposed of in terms of the compromise and the petition of compromise was also made a part of the order in fact, by such application, the parties to the proceedings prayed, to have the appeal disposed of in terms of the concerned petition of compromise and to pass a decree in terms of the same, apart from requiring the said petition of compromise to be a part of the decree.;
