JUDGEMENT

- (1.) The order dated 21.9.1998 of the District Inspector of Schools (SE), Malda is under challenge in this writ petitioner whereunder the District Inspector of Schools rejected the prayer for consideration of Higher Scale of Pay of the petitioner.
(2.) The petitioner is an approved Assistant Teacher of Jote Arapur P.N. High School who was approved vide Memo dated 05.10.1993 with effect from 02.8.1993 for two years for the subject Geography having qualification B.A. with Geography in Social Science group and later on with effect from 02.8.1995 vide Memo dated 24.11.1995 in the same group with same qualification by the respondent no. 3.
(3.) As per letter of appointment, he was appointed in Social Science group. The study leave was granted by the West Bengal Board of Secondary Education in favour of the petitioner on 16.7.2009 who enhanced his qualification as an M.A. in History but the District Inspector of Schools (SE), Malda rejected the prayer for consideration of the Higher Scale of Pay vide his Memo No. 424/G dated 21.9.1998 annexure - "P/7" informing the Secretary, Jote Arapur P.N. High School that demanded Higher Scale of Pay of Sri Ajit Kumar Saha and Sri Nirmal Kumar Sarkar cannot be considered as their demand is not justified as per relevant G. O. No. 57s dated 27.01.1995.;
