JUDGEMENT
S.B. Sinha, J. -
(1.) Heard the learned Counsel for the Petitioner and the learned Counsel for the Respondent Bank.
(2.) The Petitioner in this writ application has, inter alia, prayed for the following reliefs:
a) A Writ in the nature of Mandamus commanding the Respondents authorities to re -call and/or withdraw and/or set aside and/or quash the charge sheet, which is set out as Annexure 'C' and 'F' to Writ petition. And further commanding the Respondent authorities specially Respondent Nos. 3 and 4 not to proceed with the Enquiry proceeding on the basis of the aforesaid charge sheet.
b) A Writ in the nature of Mandamus commanding the Respondent to give opportunity to the Petitioner delinquent employee to have an access to the relevant papers and documents, Ledger etc. upon which charge is based on for the shake of preparing reply to the charge sheet in terms of the representation submitted by the Petitioner with the Respondent authorities and further commanding the Respondent authorities to give an opportunity to the Petitioner to submit reply to the charges mentioned in the aforesaid charge sheet.
(3.) Admittedly the Petitioner has been charge sheeted and the departmental proceeding has been initiated against him in terms of the charge sheet dated February 19, 1993. The Petitioner filed a representation on April 5, 1993 before the Disciplinary Authority. The Petitioner further made representations on May 13, 1993 and June 17, 1993 before the concerned authority asking them not to proceed with the Enquiry proceeding in view of the fact that he was facing a Criminal trial. The Petitioner further prayed for time to file written statement on the ground that the copies of the document mentioned in the charge sheet have not been furnished to him. The Petitioner on June 26, 1993 also filed a representation before the Chief Manager, Personnel Department, Administration Division, for permission to appoint a Lawyer as defence representative to defend him in the aforementioned departmental proceeding.;
