JUDGEMENT

(1.) Being dissatisfied with the order dated 22.04.2014 passed by the Learned Judge, 6th Bench, Presidency Small Causes Court at Calcutta, the petitioner has come before this forum.
(2.) In the Ejectment suit bearing No. 234 of 2013, the present opposite parties had filed an application under Section 5 of Limitation Act which was allowed by the Learned Court below. Being aggrieved by and dissatisfied with the said order, the petitioner has filed this application under Article 227 of the Constitution of India.
(3.) According to the present petitioner the Learned Court below failed to exercise his jurisdiction and totally lost sight of provision of Section 7(1) of Premises Tenancy Act wherein it has been specifically stated that rent should be paid within the prescribed period as mentioned in W.B.P.T. Act. He further submitted that 'abstaining from work' by the bar association may be considered as a valid ground but otherwise provisions of West Bengal Premises Tenancy Act will apply.;
