JUDGEMENT

- (1.) This writ application has been filed by sole petitioner Smt. Sonamani Hansda against respondents, 1) The State of West Bengal,
(2.) The Vice-Chancellor, Bidhan Chandra Krishi Viswavidyalaya, Mohanpur, Nadia, 3) The Registrar, Bidhan Chandra Krishi Viswavidyalaya and 4) Shri Somai Hansda praying for a direction upon concerned respondent to give her appointment in a suitable post of the Viswavidyalaya on compassionate ground due to death of her mother Mukni Hansda in harness on 01.02.1997 who was an employee under the Viswavidyalaya since 01.03.1980. Succinctly, petitioner's case is that during life time of Mukni Hansda divorce took place between herself and her husband respondent No. 4 Somai Hansda according to their tribal customs and usage. Said Mukni Hansda died in harness on 01.02.1997 leaving behind 22 years old petitioner as daughter and other two minor daughters and one minor sons who were her dependants during her life time. Falling under distress and financial stringency the petitioner applied before respondents Nos. 2 and 3 repeatedly seeking her employment on compassionate ground. She was called twice and she appeared with her testimonials for interview. She performed up to the mark in such interview but respondents Nos. 2 and 3 did not inform her about the result of said interview as per letters dated 11.7.1997 and 19.7.1997 of respondent No. 3 wherein dates of interview were fixed on 17.7.1997 and 01.08.1997 respectively. Neither the result of interview has been informed nor appointment of petitioner on compassionate ground has been given to the petitioner by respondent Nos. 2 and 3 as yet. Be it noted that after death of Mukni Hansda the respondent No. 4 has withdrawn lump sum amount from pension gratuity of Rs.40,100/- and leave salary of Rs.14,415/- in connection with death of Mukni Hansda as legal guardian of the dependant members of the deceased as granted by the appointing authority of the deceased vide Memo No. Admn/BCKU/P-14/824/D 154 dated 12.05.2004 of respondent No.
(3.) Petitioner met respondent No. 2 on several occasions seeking employment on compassionate ground. Firstly, she was given verbal assurance of giving her a job but ultimately respondent No. 3 verbally intimated her that appointment would not be given to her on compassionate ground. Hence, this writ application has been filed.;
