JUDGEMENT

(1.) Leave is granted to the learned advocate-on-record of the appellants to rectify the defects in the memorandum of appeal in terms of the report of the Stamp Reporter. This second appeal is directed against the judgement and decree dated 11th May, 2015 passed by the Learned Civil (Senior Division), Sadar, Cooch Behar in Title Appeal No. 13 of 2011 affirming the judgement and decree dated 13th June, 2011 passed by the Learned Civil Judge (Junior Division), Mathabhanga, Cooch Behar in Title Suit No.29 of 2003, at the instance of the defendants/appellants.
(2.) Let us now consider as to whether any substantial question of law is involved in this appeal for which the appeal is required to be admitted under the provision of Order 41 Rule 11 of the Code of Civil Procedure, or not.
(3.) The plaintiffs/respondents filed a suit for eviction against the defendants/appellants on revocation of licence. The defendants contested the said suit by filing written statement denying the grant of licence in their favour by the plaintiffs. They claimed title by adverse possession. After considering the pleadings of the parties and the evidence of the parties, the Learned Trial Judge decreed the suit on contest by holding that the defendants were the licensee under the plaintiffs and their licence was duly revoked and as such, the plaintiffs are entitled to get a decree for eviction as the defendants have not vacated the suit premises after revocation of licence.;
