- (1.) Since the issues involved in this Originating Summons are same and/or similar to C.S.O.S.No.2 of 2015 (Alpana De & Ors. Vs. Raikishori Seal & Ors.) and the answers given to the questions also determines the issues involved in this Originating Summons, above Originating Summons is disposed of on the same reasoning as given in Alpana De & Ors. by answering the questions in the manner following:- i) Question No.(A) is answered in the negative. ii) Question No.(B) is answered in the negative. iii) Question No.(C) is answered in the negative. However, there shall be no order as to costs. Urgent xerox certified copy of this judgment, if applied for, be given to the parties on usual undertaking.;
